Ce guide en est à sa seconde publication de juin 2010 qui a intégré des commentaires sur les Annexes III à XI de la directive et corrigé certaines erreurs de la première édition du guide. The “Guide to Application of the Machinery Directive 2006/42/EC”, the RfUs, are no legal documents; they are provided in order to give common positions on the interpretation of the Directive which is the law and to facilitate the harmonised implementation of the law. Even the harmonised standards are not mandatory but the implementation of the harmonised standards gives presumption of conformity with the Essential Health and Safety Requirements of the Directive dealt with in the harmonised standards. When the harmonised standards are revised, the RfUs are taken into account.

Les « recommendation for use »

The Recommendation for Use sheets (RfUs) are elaborated either by the Vertical Groups (VGs) or by the Horizontal Committe (HC) of the European Co-ordination of Notified Bodies under Machinery Directive 2006/42/EC. In both cases the RfUs are approved by the HC and sent to the European Commission to be “endorsed” by the Machinery Working Group (MWG); when they are “endorsed” the RfUs are published on the Europa Website (http://ec.europa.eu/enterprise/sectors/mechanical/documents/legislation/... <http://ec.europa.eu/enterprise/sectors/mechanical/documents/legislation/...> )

As already mentioned, RfUs are “endorsed” by the Machinery Working Group which gathers together representatives from the European Commission, the Member States, the CEN/Cenelec (European organisations for standardisation), the Industry (Orgalime), the Notified Bodies, the users, etc. Consequently the RfUs are useful for all the stakeholders involved in the implementation of the Machinery Directive. If an accident happens, a judge will probably look for all the documents linked with the device on which the accident happened.

RfUs CNB/M/11.045 and CNB/M11.052 were approved during the last HC meeting which took place 13.12.2011 and sent to the European Commission in order to be “endorsed” by MWG; up to now, I have not yet received the decisions of the European Commission and these RfUs are not published.

La liste des normes harmonisées

  • Les normes harmonisées donnant présomption de conformité à ces nouvelles exigences ont été revues. Dans la plupart des cas, le travail normatif a consisté à modifier les annexes ZA de ces normes qui ont intégré la nouvelle directive, le corps technique de la norme n’ayant quant à lui pas évolué. Certaines normes harmonisées qui donnaient présomption de conformité aux exigences essentielles de la directive machines ont disparu.
  • Un produit certifié selon les exigences et les normes harmonisées de la directive 98/37/CE ne satisfait donc pas automatiquement les exigences essentielles de sécurité et de santé de la nouvelle directive machines 2006/42/CE.
